Kylie Jenner to be sued for cosmetics brand imagery

Kylie Jenner may be headed to court. Los Angeles-based makeup artist Vlada Haggerty is filing a lawsuit against the youngest sister of the Kardashian-Jenner clan and founder of Kylie Cosmetics for allegedly copying one of her images.

The image in question from Kylie Cosmetics promotes the beauty brand’s holiday collection and features a woman covering her eyes while wearing red lipstick and gold-powdered fingers. The image, which was posted on November 19, is very similar to an image Haggerty shared on her Instagram page on September 24 that also features a woman covering her eyes while wearing red lipstick and gold powder on her fingers. The images have few differences like the lipstick shade, gold fingers, nail length and finger placement.
 
TMZ reported that copyright laws do not protect ideas, but The Fashion Law rebutted saying that Copyright law provides protections for original work including paintings, photos, books, sculptures, and poems among other things.

According to Haggerty, Kylie plagiarized her work in the past. Cosmopolitan reported that, according to Haggerty, Kylie Cosmetics used one of her images without crediting her. The brand later credited Haggerty without contacting her first. 
 
Kylie Jenner launched her cosmetics line with Ultrabrand in February 2016 and sold out all products that it launched. Lip Kit by Kylie, Kylie’s first beauty line, launched in November 2015 and also sold out immediately.

In July, Kylie Cosmetics added eyeshadow, in October, it launched a new lip kit for the Smile Train charity, and in November it partnered with Khloe Kardashian on a lip kit.
